Inquiries

All submissions to Aniventure require the reading of and compliance with the following submission agreement, which protects both applicants and Aniventure from potential misunderstandings or disputes.

I am submitting to Aniventure Limited written, oral, or otherwise recorded materials (“Material”) on the terms and conditions set out in this Submission Agreement (“Agreement”), which is entered into on the date of submission for good and valuable consideration, re receipt and sufficiency of which is acknowledged:

The following terms, conditions, and understandings apply to my submission of the Material:

1. I acknowledge that this submission was not commissioned and that Aniventure Limited did not suggest or request that the Material be written, created, or submitted.

2. I understand and acknowledge that, because of Aniventure Limited’s position in the entertainment industry, it receives numerous submissions of ideas for movies and programs for television and all other platforms, formats, stories, suggestions, and the like. I further understand and acknowledge that no confidential or fiduciary relationship now exists between me and Aniventure Limited and that no such relationship is established by reason of this Agreement or by reason of my submission of the Materials to Aniventure Limited

3. I represent and warrant that:
(a) I am the author and the controlling and sole owner of all rights to the Material;
(b) I have full power and authority and rights to submit the Material to Aniventure Limited and to assign and/or license the Materials to Aniventure Limited upon mutual agreement of the parties, and this Submission Agreement and any such assignment or license shall be binding not only on me but on any and all persons and entities for whom I am acting;
(c) Neither the Material nor its use in any form, adaptation, or version, does or will infringe any copyright, literary, dramatic, intellectual property, common law rights or other rights of any person or entity (including of Aniventure Limited, Cinesite Inc., their affiliates, licensors, employees, consultants or other representatives), nor, to the best of my knowledge, in any way defames, libels, slanders, or invades the privacy or any person or entity; and
(d) All of the important features of the Material, and the particular items I am submitting, are described in this Agreement and I have disclosed no other features to Aniventure Limited, its affiliates, licensors, employees, consultants or other representatives.

4. Nothing in this Agreement shall prohibit Aniventure Limited, its affiliates, licensors, employees, consultants or other representatives from using a concept or idea that it otherwise owns or controls at the time of this submission, even if that concept or idea is substantially similar or identical to the Material, where it is created independently by Cinsite Inc. or its affiliates, licensors, employees, consultants or other representatives. I agree that Aniventure Limited may use the Material, without any obligation or payment to me, to the extent that the Material is not novel, original, or so concrete as to be entitled to protection under applicable intellectual property law, or is in the public domain.

5. I understand and acknowledge that Aniventure Limited, its affiliates and their licensors, employees, consultants or other representatives have access to, may create, or have created, film or television or other media material and ideas that may be substantially similar or identical to the Material in theme, idea, plot, format, or other respects. I agree that I will not be entitled to any compensation because of Aniventure Limited’s use of any such substantially similar or identical material that may have been independently created by Aniventure or any of its employees or that may have come to it or its employees from any other independent source, whether before or after the date of this Agreement. Aniventure Limited agrees that it will not be entitled to any compensation because of the use of any such substantially similar or identical Material that may have been independently created by me or any of my employees, whether before or after the date of this Agreement. I agree and acknowledge that no presumption or inference of copying or use shall arise, or be asserted, against Aniventure Limited, its affiliates and their licensors by virtue of the fact that I have submitted the Material to Aniventure Limited or that Aniventure Limited had access to it.

6. I understand that Aniventure Limited has no obligation to provide me with any feedback, criticism, or evaluation of, or other communication regarding the Material. I understand that Aniventure Limited will not return the Material to me and I have retained at least one copy of the Material. I hereby release Aniventure Limited of any liability for loss of, or damage to the copy of the Material submitted to me.

7. This Agreement shall be governed by the laws of England and Wales and the parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection to this agreement.

8. This agreement may be signed and delivered in electronic format and by electronic transmission in counterparts, and each counterpart taken together will be deemed to be one and the same original Agreement.

9. By clicking SUBMIT I agree and accept the terms of this Submission Agreement, and consent to my electronic signature being endorsed on this Agreement.
